Missouri woman facing manslaughter charges for head-on collision

A Jefferson County woman has been officially charged with manslaughter after she killed someone in a drunk driving accident. The accident took place around noon on Nov. 4 on Route 30 east of River Ridge Road.

According to the Missouri Highway Patrol, a female driver was westbound on Route 30 when she drove her 2005 Chevrolet Impala across the center line of the highway into eastbound traffic. The 33-year-old woman struck a 1989 Ford Ranger that was headed east on Route 30. The 65-year-old male driver of the Ford truck and the female driver were both transported to a nearby hospital for serious injuries. The male driver died at the hospital about an hour after the collision.

Officers stated that the female driver was driving too fast for conditions at the time of the crash and was suspected of driving while intoxicated. Authorities did not state if a Breathalyzer test was administered to the female driver or if her blood alcohol content exceeded the legal limit for intoxication.

A .08 percent blood alcohol content is the legal limit for intoxication in all 50 states. However, drunk driving charges may still be brought against drivers even when their blood alcohol content is below the legal limit. Since the driver in this case was only charged with suspicion of drunk driving, an attorney can argue that there is no evidence that the female driver was impaired at the time of the crash and seek to reduce or eliminate some of her charges. If field sobriety tests, including a breath test, were administered and the results show that the driver was impaired at the time of the crash, an attorney may be able to argue for reduced charges if this is the driver's first DWI offense.
