Missouri man facing 9th DWI charge

A 55-year-old who has pleaded guilty to eight previous DWI charges is now facing a ninth one. Police in Maryland Heights detained the man on charges of driving while intoxicated. In an interview with local news, he said that he had a few drinks that night.

Prior to this DWI, the man had attended two treatment centers, had been to jail and had spent six years in prison on earlier charges. According to the man, he held a hardship license that allowed him to drive.

A device will be installed on the man's car that prevents him from driving after he has been drinking. He will also be required to wear an ankle bracelet and post a $25,000 cash only bond. The man claimed that he does not drink and drive.

The man may wish to speak with an attorney about an effective defense for drunk driving charges. Because he has so many prior charges, the penalties for this one could be serious. Drunk driving can affect other aspects of a person's life as well; for example, the man's mother expressed concern that he would be unable to find work. Although the man pleaded guilty to previous charges, he may wish to plead not guilty to this one and attempt to get it dismissed. He and his attorney might dispute the way in which police determined he was intoxicated or the procedures involved in detaining him. If there are Breathalyzer or blood tests, the defense may wish to challenge their accuracy. The defense might also succeed in keeping out of the trial any remarks the man made to local reporters about whether he had been drinking the night he was arrested.
