Man charged with impaired driving after crash

Missouri State Highway Patrol charged a Climax Springs man with impaired driving after he was involved in a one-car accident on Sept. 17. The 53-year-old man reportedly crashed his truck while traveling northbound on Route J at about 3:20 p.m. He was charged with DWI along with failure to stay on the right half of the road resulting in an accident, failure to maintain financial responsibility and possession of up to 35 grams of marijuana.

The accused man reportedly ran his vehicle off the road a couple of times before he crashed. When the man was just south of the Niangua River Bridge, he drifted off the right side of the road, returned to the road and then drifted off the left side of the road. Finally, the driver returned to the roadway, and his vehicle overturned.

According to the official report, the man was taken into custody at 4:02 p.m. He was released from custody so that he could be treated for moderate injuries. An ambulance took the man to Lake Regional Hospital. The man was wearing a seat belt at the time of the accident

People who have been charged with driving while intoxicated after a crash might dispute the charge by arguing that they were disoriented from the accident. If there was no blood or breath test administered, the attorney for such defendants may argue that they failed a field sobriety test because they were injured. Even if there are results from a breath or blood test, the attorney may argue that the results are too close to a known margin of error.
