Man charged with DWI after Missouri motorcycle crash

On Sept. 20, an Iowa man was injured in a two-motorcycle collision in Miller County, according to the Missouri State Highway Patrol. The crash occurred around 12:01 a.m.

Authorities said the man, who is a 51-year-old resident of Marion, Iowa, was riding his Harley Davidson Street Glide motorcycle west on Business Highway 54 near River Road when a motorcycle in front of him slowed for traffic. The Harley Davidson rear-ended the other bike, which was driven by a 50-year-old man from Ottawa, Kansas.

The Harley driver was transported to Lake Regional Hospital with undisclosed injuries. He was charged with DWI, following too close and operating a vehicle with no insurance. The second motorcyclist was uninjured. According to the police report, both men were wearing helmets.

Missouri residents charged with driving while intoxicated can face harsh consequences, including steep fines, significant jail time and the loss of driving privileges. Some people even find their job or educational opportunities threatened. As a result, a defendant may find it advisable to meet with a criminal defense attorney immediately following the arrest. Legal counsel could carefully review the case for any inaccuracies or inconsistencies that could be used in a defendant’s favor. In some cases, it may be possible to challenge the results of a breathalyzer test, particularly if the results are within the margin of error and are very close to the legal limit. Field sobriety tests could also be disputed. In other circumstances, an attorney may negotiate with prosecutors for an agreement that imposes a reduced penalty in exchange for a guilty plea to a lesser offense.
