Man charged for DWI and assault after 2-car accident

A Missouri man is facing felony vehicular assault and DWI charges after allegedly causing an accident that injured two people on Aug. 3. The two-car crash happened in Sullivan and resulted in a 22-year-old woman and her son being sent to the hospital. The accused driver apparently refused to be treated at the scene before police took him into custody.

The alleged drunk driving incident happened while the man was traveling eastbound along South Outer Road in a pickup truck. Around 11:50 a.m., police say that the man collided head-on with a sedan after crossing over the centerline close to Shamrock Drive. The sedan spun 180 degrees, and the driver ended up being trapped inside of her vehicle for at least 30 minutes.

Following the accident, the accused driver submitted to a breath test that allegedly measured his blood-alcohol content at .354 percent. He also reportedly admitted to police that he had consumed vodka before getting behind the wheel. A local reporter spoke with an individual who stated that the man was seen before the accident appearing to be very intoxicated.

A breath test reading that shows a blood alcohol content of over three times the legal limit is not necessarily accurate. In some cases, a criminal defense attorney will argue that the reading on a breath test is not reliable evidence of a driver’s level of intoxication. For example, if the accused individual was diabetic or suffered from gastric reflux, the machine could have displayed a false reading. The testing device could also have malfunctioned if it was not being properly maintained.
