DWI accident leaves 1 man dead

On Behalf of | Apr 28, 2014 | Drunk Driving

Missouri police said that a 20-year-old man was more than three times the legal alcohol limit when he was involved in a fatal accident on April 21. The man was taken into custody and charged with DWI after the deadly head-on collision in Kansas City.

The man allegedly told police that he did not feel drunk even though he admitted to drinking three beers before getting into his car. A toxicology test taken after the accident found his blood alcohol level to be .255 percent. In addition to serious DWI charges, the man is also facing involuntary manslaughter, citations for speeding and driving with a suspended license.

The accident took place around 2:15 p.m. in Kansas City’s Northland district. The man was reportedly traveling at a high rate of speed when his car veered across the centerline and into the path of oncoming traffic. He struck an approaching vehicle near the intersection of 102nd and Woodland. Witnesses estimated the man’s speed between 60 mph and 85 mph in a 45 mph zone. The driver of the second vehicle attempted to avoid the impact by pulling to the side of the road, but there was no shoulder. The driver was transported to a local hospital where he died of his injuries.

DWI penalties can be severe when an accident involves serious injuries or fatality. However, a criminal defense attorney may question police and accident reports during discussions with prosecutors. Law enforcement sometimes places all of the responsibility for an accident on an allegedly intoxicated motorist when other factors, such as contributory negligence or poor road conditions, may be partly to blame.
