Missouri man charged with vehicular homicide of friend

A man is out on bail after being charged with serious offenses related to an alleged collision with his pedestrian friend, which resulted in his friend's death. Witnesses and detectives claim that the man fled the scene.

On the night of Sept. 9, 2013, the 25-year-old man is alleged to have been drinking with his co-workers in a hotel parking lot on Kidder Street in Wilkes-Barre, Pennsylvania. Police detectives claim that the man and his 25-year-old friend, also from Missouri, then drove to McDonald's. While there, the two reportedly had an argument over the accused man's driving. A witness alleged that she saw the aftermath of a collision between the man's truck and his friend and the man driving away from the scene.

Police claim that the truck was later found in the parking lot of the hotel where the man was discovered in his room. They allege that the man was intoxicated, but refused to submit to a blood alcohol test. The man is now being charged with vehicular homicide and aggravated assault, both while driving under the influence. Additionally, charges for careless driving and failure to give aid have been filed. The charges were announced at a preliminary hearing on Jan. 29. Out on $25,000 bail, the man awaited his trial in Luzerne County Court.

Due to the severity of the criminal charges, the man faces serious jail time if he is convicted of the crimes. When someone is facing a conviction based on eyewitness testimony, it may be beneficial to question the reliability of the witness's memory. For instance, if the incident occurred at night, it might have been difficult for the witness to properly see the offender. Other times, a plea bargain might be possible in order to reduce the charges.
