Protections against unlawful search and seizure

Under the Fourth Amendment, a search occurs when a police investigation extends to a person or property over which the suspect has a reasonable expectation of privacy. This can be difficult to determine but courts usually try to decide of members of society at large would think it is reasonable to expect a certain amount of privacy.

Missouri public defenders take on more cases

In October we discussed a Missouri Supreme Court ruling that the state's public defenders may refuse new cases if their caseloads are overwhelming. The ruling came among concerns that high caseloads and limited state resources were making it impossible for public defenders to adequately represent their low-income clients.
