The National Highway Traffic Safety Administration (NHTSA) publishes data for the training of law enforcement officers around the country.  The NHTSA has established twenty clues of nighttime drunk drivers.  For example, if the officer observes the client fail to maintain a single lane (the reason given 99% of the time by officers for stopping your client) have them admit they did not observe your client commit the other nineteen clues. These twenty clues are:

  1. Turning with a wide radius.
  2. Straddling the center or lane marker.
  3. Appearing to be impaired.
  4. Almost striking and object or vehicle.
  5. Weaving.
  6. Driving on other than designated roadway.
  7. Swerving.
  8. Driving slower than 10 m.p.h. below the speed limit.
  9. Stopping in the lane for no apparent reason.
  10. Following too closely.
  11. Drifting.
  12. Tires on the center or lane marker.
  13. Braking erratically.
  14. Driving into opposing or crossing traffic.
  15. Slow response to traffic signals.
  16. Signaling inconsistent with driving actions.
  17. Stopping inappropriately.
  18. Turning abruptly or illegally.
  19. Accelerating or decelerating rapidly and
  20. Driving with headlights off.
